CBD could be deemed toxic to reproduction and could be banned in cosmetics across Europe if France finishes a process it started last year.
The European Chemicals Agency (ECHA) first publicly announced France's intention to introduce a harmonised classification and labelling (CLH) for cannabidiol last year.
According to CosmeticOBS, ECHA posted an update earlier this month, reiterating that “France has expressed its intention to classify the substance based on its potential toxicity to reproduction” and that this is “currently a proposal.”
Currently, CBD is listed on Cosing, the official European Union (EU) cosmetic ingredients database, under two headings:
Cannabidiol is produced synthetically. It is extracted from cannabis extracts, tinctures, or resins for its antioxidant, anti-sebum, skin conditioning, and skin protective properties.
CBD is not currently subject to EU cosmetics regulation. The European Commission added CBD to its cosmetic ingredients database in 2021 following a court ruling that CBD is not a narcotic drug.

The European Commission launched a call for data on the safety of pure CBD and extracts that may contain contaminants such as THC on June 1, 2023. As CosmeticOBS explains, the request comes ahead of the mandate of the Scientific Committee on Consumer Safety (SCCS), which is tasked with determining the future of these ingredients in cosmetic products.
Once this process is complete, CBD will be listed as a carcinogen, mutagen, or reproductive toxicant (CMR), which could lead to a ban on such cosmetics in Europe.
However, the ban may be waived following an opinion from the SCCS.
CBD skin care products have been experiencing a resurgence in the United States over the past few years, with cannabis-related companies like Avicanna Inc. AVCNF AVCN 0NN jumping on the opportunity.
Additionally, CBD skincare line Dr. Milagros partnered with video commerce giant QVC last year to bring its EveryFace skincare line to New York.
