On September 4, the U.S. Circuit Court of Appeals ruled that the super-potent hemp-derived cannabinoid THC-O (also known as THC-O acetate) qualifies as hemp based on the language in the 2018 Farm Bill. The decision put the court at odds with the DEA, which argues that THC-O does not meet the definition of hemp and is therefore still illegal under federal law. However, this year the Supreme Court struck down the Chevron Doctrine, meaning that the Circuit Court no longer needs to rely on the opinion of a federal agency to make its ruling. We'll have to wait and see how this plays out.
